Alphabet unit Google (NASDAQ:GOOG) (GOOGL) has filed a motion asking a federal court in Virginia to dismiss a lawsuit filed by the U.S. Justice Department (DOJ) accusing the tech giant of running a monopoly in the online advertising space. The officials at the antitrust agency “made up markets specifically for this case,” Google said in its motion seeking a summary judgment, which, if granted, will allow the company to avoid a full trial, according to a court filing on Friday. In its lawsuit, the agency has left out leading ad tech players like Amazon (AMZN), Meta Platforms’ (META) Facebook and Instagram, and ByteDance Ltd.’s (BDNCE) TikTok, which all compete for market share, the company said. “There can be no serious claim that ad placement on mobile apps and social media should be excluded in market share calculations,” Bloomberg News reported the company as saying in its court filings. Even with that definition, the company’s share in that market hasn’t met the 70% threshold required for similar monopolization cases in this part of the country, the company pointed out. The motion is part of a lawsuit that the DoJ and a group of state attorneys general filed against Google in January 2023 on allegations of antitrust violations in its ad tech business.
