A National Labor Relations Board administrative judge has decided not to look into Starbucks Corporation's (NASDAQ:SBUX) claims that the agency's structure is unconstitutional. Administrative Law Judge Geoffrey Carter said he lacks the authority to rule on constitutional issues. That means the constitutional complaints about the NLRB made by companies facing union battles such as Starbucks (SBUX), SpaceX (SPACE), Amazon (AMZN), and Trader Joe's will have to be settled by federal courts. NLRB General Counsel Jennifer Abruzzo has argued that the companies bringing the challenges over the NLRB's authority are attempting to distract from their own violations of workers' rights to organize and advocate for better working conditions. Starbucks statement: "Our focus continues to be on training and supporting our managers to ensure respect of our partners’ rights to organize and on progressing negotiations towards ratified store contracts this year." Shares of Starbucks (SBUX) slipped 0.09% in premarket trading to $76.01. The coffee chain stock is down over 20% on a year-to-date basis.
