The suit alleges that the tokens are investment contracts, and the court ruled that DraftKings' NFTs plausibly meet the criteria for securities under the Howey test. This decision follows Dapper Labs' agreement to settle a similar class action suit for $4 million in June.
The court noted that the use of Dapper Labs' proprietary blockchain, Flow, created a higher risk of violating securities laws compared to DraftKings' use of the Polygon blockchain. A date for the continuation of the DraftKings class action suit has not yet been set.
